The Firm assists individuals, businesses, and entities in the acquisition, management, and protection of their real estate assets, supporting clients at every stage — from the conduct of sensitive negotiations as their representative, through to the preparation or review of the contractual documentation.
The Firm has also developed its expertise in contentious proceedings, assisting clients in disputes relating to lease agreements, leasing contracts, and preliminary purchase agreements, property divisions, condominium relations, possessory matters, private construction contracts, as well as issues arising from tax incentive schemes for building maintenance or energy efficiency improvements (the so-called Superbonus), including disputes involving housing cooperatives or real estate companies.
The Firm also provides strategic advisory and assistance in connection with the establishment of trusts, asset earmarking arrangements (vincoli di destinazione), maintenance agreements, and other solutions designed to preserve the integrity of the estate and to facilitate its proper management, including with a view to generational transfers.
The Firm's principal has published a practitioner's handbook on "Buyer Protection in the Sale of Real Property, Movable Property, and Consumer Goods" (Tutela dell'acquirente nella vendita di beni immobili, mobili e di consumo).
Approach to real estate matters
Real estate transactions are preceded by a preliminary analysis of the documentation relating to the property concerned — where appropriate, also with the assistance of experts in urban planning and building matters — in order to enable the client to make an informed and considered decision regarding the legal relationship (sale, purchase, grant of use) that they intend to establish. The assistance then continues through the proper structuring of negotiations and contractual documentation, with the objective of preventing disputes and ensuring solutions consistent with the characteristics of the transaction.
